1. Introduction
1.1 Please read the underlying terms of use (“Terms”) before accessing and/or using the listed services. These Terms govern your rights and obligations on the access and/or use of the RSA Auto Network’s website and mobile application (“Online Service”) and subsequent services related to motor vehicle roadside assistance (“RSA Service”). These Terms constitute a legally binding agreement between you and RSA Auto Network Sdn Bhd (“RSAAN”), Company No. 123447-A, a company registered in Malaysia with registered office at M2-20-02, Menara 2, 8trium, Lot 62539, Jalan Cempaka SD 12/5, Bandar Sri Damansara, 52200 Kuala Lumpur, Malaysia.
1.2 RSAAN’s RSA Service provides customers with services such as motor vehicle towing, fuel/petrol delivery, battery replacement, jumpstart, patching of flat tyre and changing of spare tyre. These are undertaken by RSAAN’s appointed contractors or service providers.
1.3 By accessing, browsing, downloading and/or using Online Service and/or RSA Service, you acknowledge that you agree to comply with and be bound by these Terms, as amended from time to time. If you disagree with any part of these Terms, you must immediately discontinue your access and/or use.
1.4 These Terms may be revised and/or updated at any time by posting a revised and/or updated version on our website or mobile application. Unless stated otherwise, any revision or update takes effect immediately. Your continued access and/or use after a revision and/or update to these Terms constitutes your binding acceptance of the Terms.
2. Your Obligation
2.1 You must comply at all times with any instructions for use of the Online Service and/or RSA Service and you are exclusively responsible without any recourse against RSAAN for any consequences of that use.
2.2 You must provide true, current and complete information as required in your dealings with us including when setting up an account and must promptly update that information as required.
2.3 You agree that you are solely responsible for all costs and expenses you may incur in relation to your use of the Online Service and/or RSA Service; and solely responsible for keeping the confidentiality of your password and other account details.
2.4 You must undertake not to abuse, disrupt or interrupt the use of Online Service and/or RSA Service during the course of accessing your account and/or any related information.
3. RSAAN’s Responsibility
3.1 RSAAN is under no circumstances responsible for use of Online Service by the users, whether it is you or any third parties to whom you have voluntarily or involuntarily given access to your information.
3.2 RSAAN does not guarantee that Online Service does not contain any programming or errors, that it will not be the subject of any malfunctions, that use will never be interrupted or not possible, that it can be used in any locations, that there will be no loss of content or any other information, that it is suitable for a particular use or that there will never be any data transferring problem.
3.3 Neither RSAAN nor any of its employees, subcontractors, suppliers or distributors, will have to provide any compensations regardless of users if there are any direct or indirect damages resulting in particular from one of the circumstances described in the previous paragraph.
4. Service Response and Payment
4.1 All prices listed and/or quoted are in Malaysian Ringgit. The price of each RSA Service as listed and/or quoted is non-negotiable once service is accepted.
4.2 The estimated time of arrival at your exact geographical location or rendering of service will be made known once service is accepted. The estimated time shall not be taken as a binding commitment from RSAAN as the response time will depend on factors such as traffic condition, weather condition, road condition, accuracy of actual location given, distance to the nearest key towns and cities. RSAAN will endeavour to arrive and/or render the necessary service within the shortest possible time but will not be liable in the event the RSA Service was rendered late beyond the estimated time of arrival.
4.3 You may pay for any of the RSA Services using cash, bank direct transfer or credit card (depending on the availability of each payment method) upon completion of each service. You are responsible to pay for taxes if the service is taxable in addition to the cost of the service.
4.4 There will be no refunds for any RSA Services rendered.
5. Intellectual Property
5.1 RSAAN is the owner of all proprietary and intellectual property rights of the Online Service in particular the intellectual rights connected to its design, development, source code, copyright and trademarks (including all information, data, texts, visual interfaces, artworks, icons, software applications, interactive features) and other information or content made available on or through the Online Service.
5.2 You shall undertake to respect RSAAN’s intellectual rights and not to copy, forward, download or share content without obtaining the necessary rights to do so.
5.3 Subject to these Terms, you are granted a non-exclusive, non-transferable, nonassignable, personal, limited license to access and use the Online Service for your own personal and non-commercial use. All rights not expressly granted to you are reserved by us.
6. Disclaimers
6.1 The information and materials on the Online Service are provided to you for information purposes only and on an “as is” and “as available” basis without representations, warranties or guarantees of any kind either express or implied.
6.2 RSAAN shall not be liable if for any reason the Online Service is unavailable for any time or for any period. We make no representation, warranty or guarantee that your access will be uninterrupted, timely or error-free.
6.3 RSAAN warrant that Online Service will be performed consistent with generally accepted industry standards. No specific result from provision of the Online Service is assured or guaranteed. Other than those expressly set forth herein, to the extent permitted by law, we hereby disclaim all warranties, express or implied, statutory or otherwise, including but not limited to implied warranties and the warranties of merchantability, fitness for a particular purpose, in respect of the Online Service.
7. Links to Other Websites
7.1 Links included within the Online Service may let you enter into other website(s) (“Linked Sites”). RSAAN does not have any influence or control over any such Linked Sites and is not responsible nor shall it be liable for the contents of any Linked Sites or any links contained in a Linked Site or any changes or updates to such sites.
7.2 You agree that your access to and/or use of such Linked Site is entirely at your own discretion, risk and subject to the terms and conditions of access and/or use contained therein.
8. General
8.1 We may contact you if need to and we may do so by email. Notice will be deemed given 24 hours after email is sent to your designated email address. You agree that this satisfies all legal requirements in relation to written communications.
8.2 These Terms and our Privacy Policy constitute the entire agreement between you and RSAAN and supersedes any prior agreements, arrangements, statements and understandings between RSAAN and you.
8.3 These Terms shall be governed by the laws of Malaysia and each party agrees to submit to the non-exclusive jurisdiction of the Courts of Malaysia. For us to waive a right under these Terms, the waiver must be in writing.
8.4 If any part or provision of these Terms is or becomes illegal, unenforceable, or invalid under any enactment or rule of law or by any court in any jurisdiction, that part or provision is deemed to be modified to the extent required to remedy the illegality, unenforceability or invalidity. If a modification is not possible, the part or provision must be treated for all purposes as severed from these Terms. The remainder of these Terms will remain in full force and effect and continue to be binding and enforceable on you.
